TERMS AND CONDITIONS OF BOOKING AND STAY - ETERNAL SUNSHINE TENERIFE

Document drafted in compliance with the provisions of Decree 113/2015, of 22 May (Regulation of Holiday Dwellings of the Autonomous Community of the Canary Islands), Law 34/2002, of 11 July (LSSICE), and Spanish and European consumer and data protection regulations.

The present holiday home is marketed under the brand name Eternal Sunshine Tenerife (hereinafter, la Propiedad o the Holder).).


2. Definitions

  • Main guest: the natural person who makes the booking and assumes responsibility for the group.
  • Bookings platforms: página web https://www.eternalsunshine.es/ or other authorised channels where the contracting is formalised.
  • Flat: the holiday home selected during the booking process, which may be:
    Flat in Playa Paraíso — Av. Adeje 300, Playa Paraíso, Tenerife
    Flat in Playa Las Vistas — Calle Nórdica, Los Cristianos, Tenerife
    Both have a maximum capacity for 3 people and are equipped with the facilities detailed in the corresponding sheet.

3. Subject of the contract

These Terms and Conditions regulate the on-line contracting of short-stay tourist accommodation between the Card Holder and the principal Guest, as well as the rights and obligations of both parties during the contracted period.


4. Booking process

  1. Availability request through the Booking Platform.
  2. Paid in full (100 %) of the amount of the accommodation through a secure payment gateway at the time of booking.
  3. Automatic confirmation upon validation of the payment: the Holder shall submit proof of payment and a copy of these Terms and Conditions.
  4. The Chief Guest shall have 18 years complied with and provide truthful data on all occupants (art. 7 RD 933/2021, passenger registration).

5. Tariffs, taxes and inventory Tariffs, taxes and inventory

  • Prices are shown in euro (€) and including IGIC at the prevailing rate, unless expressly indicated.
  • The advertised price includingThe accommodation includes: reasonable consumption of water and electricity, bed linen, towels, final cleaning and wifi and a basic welcome pack (tea, coffee, sugar).
  • Does not include optional extras (e.g. intermediate cleaning, cot, transfer), which will be quoted separately.
  • On arrival, the following will be handed over inventory of goods; any discrepancies must be reported within 24 hours.

6. Payment

7. Cancellation and modification policy

  • Free cancellation yes if solicited with más de 15 días in advance of check-in: the full amount paid will be refunded.
  • Cancellations entre 15 y 7 días before check-in: 50 % reimbursement del importe abonado.
  • Cancellations with menos de 7 días before check-in or no-showno show): without reimbursement..
  • Date changes are subject to availability and possible fare adjustments.
The reimbursement would be made 15 days after the last booked day of stay..
For example, if the booking was from the 1st to the 15th, the refund would be made on the 30th.

If the property cannot be occupied due to force majeure (art. 1105 CC) or unforeseen circumstances, the Proprietor shall offer alternative dates or reimburse the amounts paid, excluding any other compensation.


8. Check-in y check-out

  • Check‑in: from 15:00 h (early check‑in subject to availability and possible surcharge).
  • Check‑out: before 10:00 h. Subsequent unauthorised departures will incur an additional proportional charge.
  • The Guest must give 48 hours notice of the estimated time of arrival in order to coordinate the key handover.

9. House rules and diligent use

  1. No parties or events are allowed.
  2. No smoking inside of housing. Smoking is permitted only in designated outdoor areas, using ashtrays.
  3. Pets are not allowed inside the flat and in the common areas.
  4. Respect the hours of silence between 22:00 and 08:00 and complies with the rules for common areas (swimming pool, bar and tennis court) of the residential complex.
  5. Maximum capacity of 3 guests: Children are allowed to stay when accompanied by a responsible adult.
  6. Deposit rubbish in the community rubbish room.
  7. Serious breach of these rules entitles the Owner to terminate the contract and demand immediate eviction.

10. Guest Responsibility

The Guest shall be jointly and severally liable for any damage caused by him or by persons accompanying him, including accidental damage resulting from negligent use. It is recommended to contract travel insurance covering civil liability, loss of luggage and medical assistance.

According to Spanish regulations it is compulsory to collect the information of all the people who stay in our flats, so you must send the information of the people who are going to stay in our flats. before to check in. Without this information you will not be able to access the flat.


11. Responsibility of the Holder

The Proprietor shall be responsible for providing the Guest with accommodation in a habitable and clean condition in accordance with the applicable regulations. It shall not be responsible for:

  • Outages of public utilities (water, electricity, wifi) beyond their control.
  • Theft or loss of valuables not deposited in a safe.
  • Damage resulting from force majeure (storms, urgent works, pandemics, etc.).

In any case, the liability of the Holder is limited to the total amount paid for the stay.


12. Early termination

Causes for termination of the contract include, but are not limited to, the following:

  • Failure to comply with house rules or over-occupancy.
  • Illegal, nuisance, unhealthy or dangerous activities.
  • Failure to pay on time.

In such cases, the Guest shall forfeit the amounts paid and must vacate the accommodation immediately.


13. Right of access to property

The Owner or his representative may access the accommodation with reasonable notice to carry out essential maintenance, to comply with inspections by the Authority or in emergency situations.


14. Protection of personal data

Guest data will be processed by the Data Controller in accordance with the Reglamento (UE) 2016/679 (RGPD) and the LOPDGDD 3/2018, with the purpose of manage the booking, fulfil police registration obligations (RD 933/2021) and, where appropriate, to send commercial communications when the interested party consents to this.

The rights of access, rectification, suppression, limitation, portability and opposition are informed, which can be exercised by e-mail to info@eternalshunshine.es, attaching a copy of the identification document.


15. Complaints and dispute resolution book

  • The Holder has at its disposal Official Complaints Book of the Autonomous Community of the Canaries, accessible in person and online.
  • European platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/.

16. Applicable law and jurisdiction

This contract shall be governed by the Spanish legislation. For all disputes that may arise, the parties agree to submit to the jurisdiction of the courts of Juzgados y Tribunales de Santa Cruz de TenerifeThe parties waive any other jurisdiction to which they may be entitled, except in the case of mandatory consumer legislation.


17. Modification of the Terms

The Proprietor reserves the right to modify these Terms as necessary; the applicable version will be the one published on the website at the time of booking.


18. Acceptance

By checking the box "I have read and accept the Terms and Conditions" and/or completing the booking, the Guest declares to have read, understood and accepted the present document in its entirety.


These Terms and Conditions constitute the entire agreement between the parties and supersede any prior oral agreements.
